Oxygen Lifestyle – Adventure & Wellness

These Terms & Conditions apply to all bookings for retreats, wellness experiences, adventure journeys, and safari trips operated by Oxygen Lifestyle – Adventure & Wellness (“Oxygen”, “we”, “us”, or “the Company”).
By booking an experience, you agree to be bound by these Terms & Conditions.
1. Company Information

All contracts are formed with the Irish-registered entity unless otherwise stated.
2. Scope of Services
Oxygen organises and facilitates:
- Wellness retreats
- Adventure-based travel experiences
- Nature immersion journeys
- Safari experiences in Tanzania
- Holistic wellness activities including Qigong, breathwork, meditation and related practices
Some services are delivered in partnership with third-party providers including accommodation venues, safari operators, guides, and transport providers.
3. Booking & Payment Terms
3.1 Deposit
A 25% deposit is required at the time of booking to secure your place.
3.2 Balance Payment
The remaining balance is due 60 days prior to the scheduled departure date.
Failure to pay the balance by the due date may result in cancellation of the booking and forfeiture of the deposit and any partial payments.
3.3 Payment Methods
We accept digital payments, bank transfer, and approved third-party payment providers including Klarna where available.
All prices are listed in [EUR unless otherwise stated].
4. 30-Day Cooling-Off Period
Customers are entitled to a 30-day cooling-off period from the date of the initial booking payment.
During this period:
- You may request a refund of any payments made within the 30-day window.
- The retreat, adventure trip, or safari departure date must be more than 30 days away at the time of the refund request.
- Refund requests must be submitted in writing.
- Approved refunds are subject to a 5% processing fee.
For payment plans (including Klarna), the 30-day period begins from the date of the first payment.
After the 30-day cooling-off period expires, the cancellation terms below apply.
Refunds are processed within 5–10 business days to the original payment method.
5. Cancellation by Participant (After Cooling-Off Period)
Due to advance commitments with accommodation providers, safari operators, guides, and suppliers, the following cancellation terms apply:
- 60 days or more prior to departure: 20% of total trip price retained
- 59–31 days prior to departure: 50% of total trip price retained
- 30 days or less prior to departure: 100% of total trip price retained
All cancellations must be submitted in writing.
The effective date of cancellation is the date written notice is received.
6. Cancellation by Oxygen
Oxygen reserves the right to cancel or reschedule an experience due to:
- Insufficient participant numbers
- Operational reasons
- Safety concerns
- Force majeure events
If Oxygen cancels a trip for operational reasons, participants will receive a full refund of payments made.
Oxygen is not liable for external costs incurred by participants (e.g., flights, visas, insurance).
7. Force Majeure
Oxygen shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:
- Natural disasters
- Government travel restrictions
- Political instability
- Pandemics
- Airline disruption
- Acts of terrorism
- Civil unrest
In such cases, Oxygen may offer rescheduling or credit at its discretion.
8. Travel Insurance
Comprehensive travel insurance is strongly recommended and is the sole responsibility of the participant.
Insurance should include coverage for:
- Trip cancellation
- Medical expenses
- Emergency evacuation
- Personal belongings
- Travel disruption
Oxygen is not responsible for personal circumstances preventing participation.
9. Health & Fitness
Participants confirm that they:
- Are medically fit to participate
- Have disclosed relevant health conditions
- Accept responsibility for their physical and mental wellbeing
Oxygen reserves the right to refuse participation where health or safety may be compromised.
10. Mount Kilimanjaro & High-Altitude Expeditions
This section applies specifically to participants booking Mount Kilimanjaro treks or any high-altitude expedition organised or facilitated by Oxygen Lifestyle – Adventure & Wellness.
10.1 Inherent High-Altitude Risks
Participants acknowledge that trekking Mount Kilimanjaro involves significant physical exertion and exposure to high-altitude conditions exceeding 2,500 metres and reaching approximately 5,895 metres above sea level.
Risks may include, but are not limited to:
- Acute Mountain Sickness (AMS)
- High Altitude Pulmonary Edema (HAPE)
- High Altitude Cerebral Edema (HACE)
- Severe weather conditions
- Remote terrain with limited medical facilities
- Delayed evacuation due to environmental factors
Participation is voluntary and undertaken at the participant’s own risk.
10.2 Summit Success Not Guaranteed
Summit success is dependent on multiple factors including, but not limited to:
- Individual acclimatisation
- Physical fitness
- Weather conditions
- Safety assessments by guides
- Health status during ascent
Oxygen Lifestyle – Adventure & Wellness does not guarantee that any participant will reach the summit of Mount Kilimanjaro.
Failure to reach the summit for any reason, including medical or safety decisions, does not constitute breach of contract and does not entitle the participant to any refund or compensation.
10.3 Guide Authority & Mandatory Descent
Participants acknowledge that designated mountain guides retain absolute authority regarding safety decisions during the expedition.
If, in the professional judgment of the lead guide or medical personnel, a participant shows signs of altitude sickness, medical distress, or unsafe physical condition, the guide may require immediate descent.
Such decisions are final and made solely in the interest of participant safety.
Mandatory descent does not entitle the participant to refund or compensation.
10.4 Compliance with Park Regulations
Mount Kilimanjaro is regulated by the Tanzania National Parks Authority (TANAPA).
Participants agree to comply with:
- All park regulations
- Environmental protection guidelines
- Guide instructions
- Safety procedures
Changes imposed by park authorities, including route adjustments, safety directives, or regulatory updates, do not constitute grounds for refund or cancellation.
10.5 Mandatory Insurance Requirement
Participants joining Mount Kilimanjaro expeditions must obtain comprehensive travel insurance that includes:
- High-altitude trekking coverage up to 6,000 metres
- Emergency medical treatment
- Helicopter or ground evacuation
- Repatriation
Proof of valid insurance will be requested prior to departure.
Failure to obtain appropriate insurance may result in refusal of participation without refund.
10.6 Medical & Evacuation Responsibility
Participants acknowledge that emergency evacuation in high-altitude environments may be:
- Weather dependent
- Delayed due to terrain
- Logistically complex
All medical treatment and evacuation costs are the sole responsibility of the participant.
Oxygen Lifestyle – Adventure & Wellness accepts no liability for medical expenses or evacuation costs incurred during the expedition.
11. Assumption of Risk & Liability
Participation in retreats, adventure activities, and safari experiences involves inherent risks including but not limited to:
- Physical activity
- Wildlife exposure
- Remote environments
- Transportation risks
By booking, participants acknowledge and accept these risks.
To the fullest extent permitted by law, Oxygen shall not be liable for:
- Injury
- Illness
- Loss
- Damage
- Delay
Except where caused by proven negligence.
12. Third-Party Suppliers
Certain services are provided by independent third-party operators.
Oxygen acts as organiser and facilitator but is not liable for the acts, omissions, or defaults of third-party suppliers.
13. Changes to Itinerary
Oxygen reserves the right to make reasonable changes to itineraries due to:
- Weather conditions
- Safety considerations
- Operational requirements
- Wildlife movement (for safari experiences)
Such changes do not constitute grounds for refund.
14. Complaints Procedure
Any concerns must be raised immediately during the trip to allow resolution.
Formal complaints must be submitted in writing within 14 days of trip completion.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Ireland.
Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
SAFARI-SPECIFIC ADDENDUM
(For Tanzania Retreats & Safari Experiences)
This Addendum applies to all Tanzania-based retreats and safari journeys.
A. Wildlife Acknowledgment
Participants acknowledge that:
- Wildlife encounters are unpredictable.
- Animals are not controlled or restrained.
- Safety instructions from guides must be followed at all times.
Failure to follow safety instructions may result in removal from activities without refund.
B. Safari & Remote Environment Risks
Participants acknowledge risks including:
- Travel in remote areas
- Limited medical facilities
- Variable road and transport conditions
- Weather exposure
C. Emergency Medical Evacuation
Participants are solely responsible for obtaining insurance that covers:
- Emergency evacuation
- Repatriation
- Air ambulance services
Oxygen is not responsible for medical evacuation costs.
D. Visa & Entry Requirements
Participants are responsible for:
- Passport validity
- Visa requirements
- Vaccinations
- Entry documentation
Oxygen is not responsible for denied entry.
E. Local Operators
Safari services may be operated by licensed Tanzanian partners.
All local operators comply with Tanzanian tourism regulations.
Contractual responsibility remains with the Irish entity of Oxygen unless otherwise stated.
